In using this Website, you are deemed to have read and agreed to the following terms and conditions.
Terminology
The following terminology applies to these Terms and Conditions and any or all Agreements:
“User”, “You” and “Your” refers to you, the person accessing this website and accepting the school’s terms and conditions.
“The school”, “Ourselves”, “We” and “Us”, refers to our organisation, Realist Academy.
Downloading Images Copyright Agreement:
The Website is owned and operated by Louis Smith. All photographed images and illustrations are the property and copyright of Louis Smith/realistacademy.com. No images or their parts may be reproduced, stored in a retrieval system or transmitted in any form or by any means, electronic, mechanical or otherwise without prior written permission from Louis Smith.
You are not entitled to modify or redistribute the content of the Website or reproduce it in any other Website without the express written permission of Louis Smith. You are not entitled to use the content of the Website for commercial exploitation in any circumstances.
Copyright and Ownership of Materials:
All of the images on this website are copyright Louis Smith/realistacademy.com unless otherwise credited. All rights are reserved, and no usage or reproduction of any type may be made of any image taken by or copyright to Louis Smith without the express permission of Louis Smith.
Use and Reproduction:
You cannot download or use images from realistacademy.com without seeking permission from the copyright holder.
If you would like an image for personal use or study, you can order our most popular pictures on realistacademy.com. The downloadable images are for the sole use of the individual customer only.
Short Workshops/Courses
- Participants must be aged 18 or over to book a place on a course.
- Realist Academy reserves the right to withdraw its courses if the minimum number of students has not been met one week before the course is due to start. In this case we will refund your fees.
- Your place is not confirmed on the course until we have received your fees in full.
- There is no deposit or instalment process.
- Good time keeping throughout the Workshop/Course is essential.
- Failure to attend classes does not entitle participants to refunds, extra tuition or a transfer.
- We reserve the right to reschedule or cancel courses. Reasons for this may be, but not restricted to, low enrolment numbers, strikes, weather warnings and teacher availability.
- We cannot guarantee any specific results or outcomes from the Course/Workshop. The students who gain the most from the course will be the students who listen carefully and commit time to practice regularly.
- If you have a disability/additional support need, please contact us before booking as aspects of some Courses may be unsuitable due to the nature of the location. Please ensure that you provide us with full details of any specific requirements that you may have, and we will endeavour to accommodate you.
Portrait Painting Course
- The Portrait Painting Course is for students aged 18 and over.
- The course runs for one academic year and is divided into three terms.
- Admission is subject to availability.
- A deposit of £200 is required to secure your place. The deposit forms part of the total course fee.
- The total fee for the one-year course is £2,925, including the £200 deposit.
- By enrolling, you are committing to the full one-year course and agree to pay the full course fee. For convenience, the course fee may be paid in three termly instalments of £975, with the £200 deposit deducted from the first instalment.
- Each term’s payment must be received by the 3 weeks before the start of that term. If payment is not received when due, Realist Academy reserves the right to withdraw your place.
- If you cancel 3 or more weeks before the course starts, your deposit will be refunded.
- If you cancel less than 3 weeks before the course starts, the deposit is non-refundable unless we are able to fill your place.
- Cancellation after the course starts: Once the course has commenced, fees already paid are non-refundable. This does not affect your statutory rights.
- Where a booking is made online, any statutory cancellation rights, including any applicable 14-day cancellation period, will apply.
- Failure to attend classes does not entitle students to a refund, additional tuition or a transfer.
- If you have been provided with Online Study Materials and subsequently cancel, access to those materials may be withdrawn.
- Realist Academy reserves the right to reschedule or cancel classes or courses where reasonably necessary, including due to low enrolment, severe weather, strikes or teacher availability. Where Realist Academy cancels a course and cannot provide a suitable alternative, any applicable fees for tuition not provided will be refunded.
- Students may not record or distribute class activities without the teacher’s written permission. Any approved recordings are for the student’s private use only.
- Good timekeeping throughout the course is expected.
- Realist Academy cannot guarantee specific results or outcomes. Progress will depend partly on each student’s attendance, participation and independent practice.
- If you have a disability or additional support requirement, please contact us before the course so that we can discuss your needs and any reasonable adjustments that may be available.
Payment:
- Payment of invoiced fees to be made via bank transfer.
- Cash payments are not accepted in any currency.
- All prices are in pounds sterling (£)(GBP) and are not currently subject to VAT.
- Don’t hesitate to contact Louis Smith if there’s an issue with the payment or if you have any questions.
Health and Safety:
You will be expected to wear suitable clothing and footwear in the studios and workshops and follow the health and safety instructions of your tutor at all times. Failure to follow health and safety instructions may mean that you cannot participate in certain activities.
Liability:
- Realist Academy does not accept liability for loss or damage to materials or artwork left in the school. Belongings are left at the students’ own risk.
- You must indemnify us against all damages, costs, claims and expenses suffered by us arising from any loss or damage to any equipment (including that belonging to third parties) caused by you.
- Neither of us is liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond the reasonable control of that party. Such causes include, but are not limited to: industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the party in question.
Responsibilities:
- Respect between all parties is of the utmost importance, derogatory, disruptive and negative behaviour will not be tolerated.
- All students are expected to conduct themselves in a reasonable manner and accordance with our rules and regulations and to recognise that other students also require support and assistance.
- You agree to conduct yourself in a professional and courteous manner and refrain from causing offence or nuisance to your teacher.
- You agree to ensure you have the necessary equipment and materials available for the Course/Workshop, as specified in the course materials.
- It is student’s responsibility to check emails regularly.
- We welcome diversity as a source of strength.
- Your tutor will ask you to tidy up just before the end of class. Please ensure that the studio is left clean and tidy for the next class.
- Smoking (including the use of e-cigarettes) is absolutely prohibited at the Realist Academy.
- You are responsible for arranging your accommodation and transport where applicable.
Confidentiality:
Your privacy and personal information are important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.
Notification of changes
Realist Academy reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms.If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site.Any changes to our privacy policy will be posted on our web site – you are therefore advised to re-read this statement on a regular basis.
